Welcome to the General Terms and Conditions (hereafter GTC) side of the www.eclectickdesign.com web shop

GTC should be read carefully before purchasing from the web shop.  You should continue with the services only if you agree with each points and accept the mandatory requirements as applying to yourself. When you purchase from the web shop you automatically agree with the terms and conditions hereunder. This document is not registered and comprises an agreement in electronic form only and it does not refer to the Code of Conducts.

The contract is written in Hungarian in electronic format and automatically stored. It is accessible for the User after registration on the web shop. Its content can be read stored and printed.

In case of any questions and requests about the workings of the web shop or the order and delivery process please contact us at the given addresses.

GTC can be changed anytime, unilaterally, for this reason please always read it before placing your order.

The products on the www.eclectickdesign.com  website   are the artwork of Edina Gyovai-Farkas, the designer of PLANE-TICK Clothing Designer and Commercial Limited. Most of them are made according to specific order: only a few are ready made products. Detailed information about specific ordering and timing of the production can be found on the information side of the specific product. On the information side the photo of the product and its size, colour, composition and other useful information can be found.  We draw particular attention to the fact that the picture of the product in the Web shop’s information side can differ in minor details from the product sent for your order. These minor differences do not mean breach of contract of the supplier. Warrant claims and legal consequences because of breach of contract are not valid. If you have questions please write to info@eclectickdesign.com .

The purchase does not need a registration, but you can register yourself in the Web shop any time to simplify future ordering.  For registration all data has to be filled out thoroughly as we do not take responsibility for delay in delivery or any other problems due to inaccurate or wrongly given data.  After the registration the system sends a confirmation e-mail to the given electronic address. By clicking on the link in the email the registration can be activated. The data added in the registration can be changed later. As a registered User of the web shop you can enter the web shop by giving your username and password. If you forget your password and you add the username or the registered email address the system sends a verifying code. By adding the verifying code you can add your new password.

After finding and choosing the produce you want to buy, click the “Add to Bag” button. On the information page of the product the quantity of the required item can be set.

After putting the product into the shopping bag you can return to the products of the web shop menu or choose to start of the order of the product in the “Shopping Bag” by clicking on „Checkout”. You can also delete the product from the Shopping Bag or change the amount of the products. If you have a coupon code you can use it at this point. You can check the contents of the shopping bag in the menu at anytime during the purchase. By clicking the “Checkout” icon you can give your billing data and address for delivery. As you fill in your data you can sign in and create your own account in the web shop. To do this you have to click the little square next to the “Sign in for account” caption. After clicking you can give your password for your account. If you do this, you can log in next time and you do not have to give all your data for future purchases.

Before paying under point “Completion of Order ” you can have a look at the products you have chosen. There you can also see the delivery options and you can choose the best option that suits you. After that you can choose payment.

Before sending the order you have to indicate with tick that you accept this GTC, without it you cannot order. Lastly, by clicking the “Place order” icon you finalize your order.

For exclusive orders with photos you can upload the pictures right after sending your order.  Using the order code number you will be able to upload pictures later on by using the “Upload Picture,” point in the menu. If you are not able to upload your pictures or you have any questions, please contact us at the addresses detailed above. It is important to note that the production time only will start when we have received the suitable photo, as we can only start the work if we have the picture. This does not depend on the time of placing the order.  We will confirm the order electronically as soon as possible after the order. The confirmation consists of the data you have given us (e.g.  billing and delivery data), the date of the order, the number of ordered products, the price of the products, the delivery price and the sum total to pay.  This confirmation email only informs you that we have received your order. The confirmation also includes the code number of the order. You have to refer to this number if you have any questions about the order. If the confirmation does not arrive to you in 48 hours, you are not bound by contractual obligations.  We also send you an email when your order is completed and sent.

The contract comes into existence after this process.

 

The contract is related to the Act CVIII. of 2001 law on electronic trade and services of information society. The contract is covered by the particular regulations of 45/2014 (II.26.) Ordinance of contracts between consumers. It complies with the Directive 2011/83/EU of the European Parliament and Counsel of the rights of the consumers.

The prices of the products on the Website are gross prices, stated in Hungarian Forints. This includes the current Value Added Tax (hereafter: VAT). The price of the products does not contain the delivery cost. This depends on the delivery method you choose. The delivery cost contains the cost of packaging.

 

The payment of the product(s) is possible in 3 ways:

– In case of collection in person the price is paid in cash

– by bank transfer to the bank account of the Operator PLANE-TICK Clothing Designer and Commercial Limited.  Bank account: CIB Bank, 10700691-65973842-51100005

– by bank card through Barion electronic payment service

The method of payment has to be chosen on the „Cash” site by choosing the „Method of payment” menu point.

When you transfer the cost of the product it is compulsory to add the order number in the statement row.

If you chose the bank transfer, or Barion, option in the order and the cost of the ordered products is not paid in 5 days to the given bank account, we are freed from the obligations of the offer and not liable to fulfill the order.

We send the bill with the ordered product to you. The bill includes the price and the delivery fee of the product.

After sending your order and the ordered product is completed in the period of production time given on the website, the product can be delivered to you in 4 ways:

-In case of collection in person there is no delivery fee. The place of collection: Budapest, District 9, between 8a.m.-8p.m. Prior consultation is needed.

Domestic orders taken In our web shop are delivered by Foxpost and GLS delivery services

In the case of using a parcel terminal the delivery service sends an sms message when the parcel arrives.  You can collect your parcel during the opening time of the specific terminal.

 

In the case of delivery to your door, the delivery is done during working days, between 8am-5.pm. (Please note that Saturdays and Sundays are not business days). If you are not at home during that time it is helpful if you give your work address (if possible) as a place to deliver to.

We use the service of Magyar Posta Zrt. To deliver abroad

 

Delivery is according to the rules of the particular delivery service. Generally speaking domestic delivery takes 2-3 working days. In the EU it takes 3-6 working days and in the case of countries outside EU delivery it takes 4-8 business-days. However during certain periods like holidays or during sales the delivery time may be longer. In any case after sending the parcel, the delivery service company will deliver it according to its own business regulation. We are not responsible for the duration of the delivery. If you do not receive your order on the last appointed working day, please contact us at info@eclectickdesign.com . In this case, with the help of your parcel number, we can check your parcel’s current delivery status.

 

If you find the product is damaged, it is compulsory for the deliverer to take details of your request.  The deliverer bears the responsibility for the damage.

Please note that after sending your order you cannot change the delivery address. For this reason be very precise when you give the address for delivery. If you realize there has been a mistake, please inform us within 24 hours using one of the given methods of communication

Your right of withdrawal is based on the particular regulations of 45/2014 (II.26.) Ordinance of contracts between consumers. You can withdraw from the buying of the ordered products within 14 workdays without a reason. The 14 day deadline starts at the day of the arrival of the ordered product. Please note that you cannot exercise your right in cases of ordering unique products. For this reason be very precise when you order KID FACE dolls and t-shirts and KID ART products and choose he size, the colour and the design.

If you want to exercise your right of withdrawal in case of a product that is not unique, please let us know as soon as possible on the given email-address on the “Contact” side. In the withdrawal statement you need to enter all the data included in the order, the code number of the order, the date of the order and the date of receipt of the product.

 

In case of a withdrawal you are required to send the products for us in appropriate packaging (at least in similar package in which you received the product) which guarantees that the products cannot be damaged. The cost of the return is paid by you. In the case of withdrawal you are bound to send back the enclosed bill to us. Our address is: Gyovai-Farkas Edina, 1151 Budapest, Bánk bán utca 11. After receiving the withdrawal statement we will reimburse the price paid by you within 30 days. For reimbursement the product has to be undamaged and unused, and received by us before the 30 day deadline. We are entitled to subtract the damage of the product if it was used wrongly. We do not reimburse the delivery fee.

If you agree, and have not stated a different, preferred method of reimbursement, we reimburse the price paid by you by bank transfer. You do not have any additional cost because of the method of payment.

 

Guarantee and expiry date

The guidance for the responsibility of the Supplier for the guarantees and expiry dates are in the Civil Code and the 19/2014. (IV. 29.) NGM regulation.

We have a 6 months guarantee for all of the products. We only have to fulfil the guarantee claim if the product has a material and manufacturing defect and was used for its intended purpose.

If the product is damaged during the expiry time and up to the expiry date please contact us and send the purchase bill or its copy back to us. We will register your notice including your name, address, the name of the product, the price of the product, the date of purchases, the description of the damage, your claim and a way it can be resolved.

We examine the product and amend it as far as possible or replace it. If this is not possible we send you a refund.  The costs of legitimate guarantee claim are paid by us (included the delivery fee, the cost of amend and replacement).

For your complaint to be handles you have to enter all data of the order, including the confirmation code for the order. We need this data to identify the order.

We consider oral complaints immediately; we inform the complainant of our point of view and solve the complaint if at all possible. If it is not possible to solve the complaint because of the type of the complaint, or you do not agree with the handling of the complaint, you need to send a written complaint to us. In this case we consider and answer the complaint within 5 days. The answer always contains an explanation of our reasons.

Legal proceeding. You have a right to bring legal proceeding consumer dispute claims before court in civil proceedings on the basis of the Act VI of 1959 on the Civil Code of the Republic of Hungary and Act V of 2013 on the Code of Civil Procedure.

We keep the complaint correspondence for 3 years.

The pictures, photos that appear on the Website are the exclusive property of PLANE-TICK Clothing Designer and Commercial Limited.  Their use and distribution are prohibited without the prior permission of the owner.  The photos and pictures sent by the purchasers can be used only by the certain purchaser and PLANE-TICK Clothing Designer and Commercial Limited. Our business and the owner of the website have written permission from the purchasers to use their pictures and photos on the website.

 

A honlapon feltüntetett képek a Plane-tick Bt. tulajdonát képezik, annak terjesztése, használata, hozzájárulásunk nélkül nem megengedett. A vásárlók által beküldött képeket kizárólag az adott vásárló, illetve a Plane-tick Bt. használhatja. Ezeknek, a webshopon való megjelenéséhez, cégünk a webshop üzemeltetője írásbeli hozzájárulást kért a vásárlóktól és kizárólag ennek megléte után helyezte el az oldalon.
